3.  Your Account

3.1 By using shop.malta.com you warrant that you have legal capacity to enter into these Terms and Conditions. You are obliged to read and accept our terms and conditions at the time of placing your order.

3.2 The responsibility of maintaining the confidentiality of your account, password and restricting access to your computer to prevent unauthorised users to access your account on shop.malta.com is held by you. You accept responsibility to every action performed under your account and password. If in any case you have any reason to believe that your password has become known to anyone else, you have to contact us immediately. Please ensure that all details you provide us with via your account  are correct and complete. You can access and update most of the information in your account available on the website.

3.3 Web Edition Ltd reserves the right to terminate accounts, refuse access to shop.malta.com and to decline orders at any time.

4. Access to shop.malta.com

4.1 We will do our best to ensure the availability of shop.malta.com, that it will not be interrupted and that any transmissions will be error-free. However, this is not always guaranteed due to the nature of the Internet.

4.2 Access to shop.malta.com could sometimes be suspended or restricted to allow for site maintenance or repairs; however we will do our best to limit the frequency and duration of any such suspensions or restrictions. 

4.3 We will not be held liable for failure to communicate with you due to any failure on behalf of service providers and electronic communications providers or faults in their networks and equipment.

 
5. Your Conduct

5.1 You must not use shop.malta.com in any way that would cause it to be interrupted or tempered with in any way. You must not use the website for fraudulent purposes or to use or reuse any material that is illegal.

 
6. Pricing

6.1 All prices shown on shop.malta.com are priced in Euro and are inclusive of VAT unless stated otherwise.

6.2 Whilst we always try to ensure that all our prices on shop.malta.com are accurate, genuine mispricing can occur. In this event, we are not required to sell the goods to you at the price shown. Upon discovering an error in the price of any purchased good, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or else cancelling it. If we are not able to contact you within ten (10) days, we will regard your order as cancelled. If cancelled and you would have already paid for your item, you will receive a full refund.

6.3  Prices on shop.malta.com can change frequently and could also be affected on all unpaid goods in your shopping cart. Therefore, it is your sole responsibility to  check the prices of the products in your shopping cart regularly.

  
7. Availability of product

7.1 The products and services displayed/shown on this website are supplied by third parties and not by shop.malta.com

 7.2 shop.malta.com provides an indication of whether any product is available or not, however confirmation of availability will be done after we view your order. We will do our best to provide you with the product of your choice. However, due to unforeseen circumstances, some items might become unavailable after you have placed an order.  

7.3 If this unexpected circumstance occurs and any or all of the products you ordered turn out to be temporary or permanently unavailable, we will inform you by not later than the next business day. We reserve the right to deliver products within 30 days beginning from the next business day after you purchase the product or products. If we are unable to deliver within 30 days, we will provide a refund in full for any items we were unable to deliver. shop.malta.com shall not be liable for any loss or damage whatsoever arising from such cancellation or order.


8. Payment Security and Payment Methods

All payments of invoices issued by www.malta.com (represented by Web Edition Ltd) using the online credit card facilities are subject to the following conditions.

8.1 Endeavour, also known as CardPayDirect.com is the secure method of payment that shop.malta.com uses. Endeavour is a Level-1 PCI Certified Payment Gateway. This payment gateway service provider is approved by both BOV and HSBC and handles thousands of transactions a day. Web Edition Ltd. does not collect your credit or debit card details, as they are processed directly by Endeavour on their highly secure servers.

8.2 Web Edition accepts the following payment options:

You undertake and agree to provide correct details for the purpose of ordering and/or purchasing goods from this website. You also undertake to ensure that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered. Your card details are received, processed and transmitted directly by a PCI compliant payment gateway provider, through our website. Web Edition Ltd does not at any point handle and or share the card information.

8.3 When you complete the online payment form, funds will be deducted from your credit card in the selected currency. 

8.4 Payments are debited to Web Edition Ltd.

8.5 Credit card payments are secure:
Credit card numbers are protected with a high level of encryption when transmitted over the Internet. Web Edition Ltd does not have access to your credit card details.

8.6 Confirmation of payment :
-    If successful, we  will confirm that your payment was completed.
-    If unsuccessful, we will advise that your payment has failed.
-    If your payment fails, please use one of the other payment methods described on your invoice, to pay your invoice. Please arrange an alternative payment method promptly to ensure continuous use of Web Edition Ltd services and Internet resources.

8.7 Web Edition Ltd will confirm your payment and the details of your order via email.

8.8 Web Edition Ltd's Terms and Conditions for online credit card payments are subject to change at any time. Each transaction shall be subject to the specific Terms and Conditions that were in place at the time of the transaction.
 

9. Delivery

9.1 Delivery of goods purchased from shop.malta.com is free for standard delivery to Malta and Gozo. Express delivery might be offered for an extra charge for certain products as shown on the website. For international delivrery, we apply the rate of MaltaPost (http://www.maltapost.com/post-it-postage-rates) which is the carrier that we will use by default. 

9.2 Deliveries are generally made during normal working hours. We aim to arrange shipment of all items within 24 hours of receiving your order. The majority of our product portfolio is displayed on this web site, however only items “in stock” can be purchased.       

9.3 Upon delivery, you should inspect the goods and report any loss or damage to us immediately. In respect of any damage to goods reported to us after delivery we shall require proof from you that the goods were damaged before receipt by you. 

9.4 We will not be held responsible if you give us an incomplete delivery address


10. Cancellations and Return Policy

10.1 Refunds may be granted up to 15 days from receipt of the product. So, if you change your mind, you can cancel your order within 15 days of receiving your order/products. You can return the items to us, and we will refund you for the purchase. Returned items must be returned unused and in the original packing.
This does not apply to event tickets and vouchers which are both non-refundable and non exchangeable.

 
10.2 Once we receive the returned product and approve its condition, we will refund you the purchase price paid for that product less delivery costs and payment processing cost if any.

10.3 All returns to Web Edition Ltd must be returned with the receipt as proof of purchase.
 
10.4 If your product becomes faulty during use we recommend that you contact the manufacturer of the product directly for a warranty repair or replacement and to return the product to the manufacturer. This is often the quickest way to resolve a fault. We will  give you contact details and other information and assistance as you may need for this purpose. We would also be happy to handle the warranty claim with the manufacturer on your behalf, in full conformance with the contract of sale being made between us.

10.5 For the purposes of this term, ‘faulty’ does not include fair wear and tear, wilful damage or negligence by you, accident, and use of a product otherwise than in accordance with our instructions or the manufacturer’s instructions.

10.6 Cancellations of orders can be done at any time prior to dispatch of order and this can be done via e-mail on contact@malta.com, through our online live support system, or by phoning on 20608800 during normal working hours, You need to quote the order reference number, and your contact details.

 
11.  Electronic Communications

11.1 When visiting shop.malta.com or sending us emails, you are communicating with us electronically. In return, we will communicate with you by e-mail, by posting notices online, through our live support available on the website or by phone as necessary. You consent to communicate with us electronically and agree that all agreements, notices, disclosures and other electronic communications that we offer you, satisfy any legal requirement that such communications be in writing. Your statutory rights are not affected.


12.  Warranty

12.1 All products have a manufacturer’s warranty. Subject to any mandatory provisions of law, the products manufacturer will define this warranty period.

13.1 All content on shop.malta.com, including text, graphics, images, audio clips, logos, button icons, software and data compilations is the property of Web Edition Ltd, its affiliates or its products suppliers and is governed accordingly by intellectual property laws.

13.2 No part of this website may be copied, reproduced or used in any way without the consent of Web Edition Ltd.

 
14.  Amendments of Terms and Conditions

13.1 Web Edition Ltd. reserves the right to, amend/alter/delete or terminate these Terms and Conditions at any time and for any valid commercial, technical or operational reason.The latest version of the Terms and Conditions would always be available via shop.malta.com therefore it is your responsibility to ensure that you are conversant with any changes.


15.  General 

15.1 To the fullest extent permitted by law, shop.malta.com is providing this site and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, shop.malta.com does not represent or warrant that the information accessible via this site is accurate, complete or current.


16.  Language of the Terms and Conditions

16.1 The official language used in these Terms and Conditions is the English language.


17.  Jurisdiction and Applicable Law

17.1 Any dispute relating to the products and the validity, performance and construction of these Terms and Conditions and the use of shop.malta.com shall be exclusively solved in terms of Maltese law. Where recourse to the Courts of Law is necessary, the Courts of Justice of Malta shall have exclusive jurisdiction.
